BREAKING: Supreme Court Halts Kpandai Rerun, Orders EC to Suspend Election Preparations

The Supreme Court has issued a directive ordering the Electoral Commission (EC) to immediately suspend all preparations for a parliamentary rerun in the Kpandai constituency. The order pauses the electoral process pending the final determination of a case challenging the High Court’s annulment of the 2024 election results.

The ruling was delivered on Tuesday by a five-member panel of the apex court, presided over by Justice Pwamang. The panel includes Justices Kulendi, Tanko, Samuel Asiedu, and Henry Kwofie.

The judicial intervention stems from an application filed by the New Patriotic Party’s (NPP) 2024 parliamentary candidate for Kpandai, Matthew Nyindam. Nyindam is seeking to overturn a November 24, 2025, judgment from the Tamale High Court, which nullified his election victory following a petition by the National Democratic Congress (NDC) candidate, Daniel Nsala Wakpal.

In its decision, the Supreme Court stated that the applicant had established a prima facie case warranting a full hearing. Consequently, the court has put on hold the EC’s planned rerun, which the Commission had announced via a press release.

During Tuesday’s hearing, Nyindam’s lawyer, Gary Nimako Marfo, informed the court that the NDC’s Wakpal had not been formally served with the judicial review application. Marfo successfully prayed the court for an order for substituted service.

The court granted the request, authorising service to be effected by:

Posting the legal documents at Wakpal’s known residence in Kpandai.

Posting on the notice boards of the Tamale High Court and the Kpandai District Court.

Sending the documents via WhatsApp to a confirmed phone number belonging to the NDC candidate.

The documents must remain posted for seven days, after which service will be deemed complete.

A critical component of the order directly instructs the Electoral Commission, represented in court by Justin Amenuvor, to halt all arrangements for the conduct of the fresh election until the substantive case is heard and determined.

The Supreme Court has adjourned the matter to January 13, 2026, for the next hearing.
